Web Design Terms & Conditions

These terms and conditions apply to all users of our network of sites, including EnigmaDesigns.pro and BuybackEmpire.pro.

1. Introduction

These Terms & Conditions apply to all web design services and ready-made projects provided by EnigmaDesigns.pro. By commissioning services or purchasing products, you agree to be legally bound by these terms.

2. Scope of Work

Project scope, features, and timeline outlined in written agreement
Additional features requested post-commencement may incur separate fees
Ready-made projects include 3 months bug fix support from setup completion. View full support policy.

3. Payment Terms

50% deposit required before work begins
Balance due prior to final handover or going live
Payments non-refundable after work commencement

4. Client Responsibilities

Provide all required content in timely manner
Ensure content doesn't infringe third-party rights
For ready-made projects: Provide cPanel cloud linux os hosting environment

5. Project Delivery

Delivery after final approval and full payment
For ready-made: License activation upon domain verification

6. Hosting & Domains

Client responsible for hosting/domain unless specified otherwise
Ready-made setup support exclusively for cPanel cloud linux os environments

7. Intellectual Property

Ready-Made Projects License

Perpetual domain-locked license for one authorized domain
License key cryptographically verified against domain
We reserve the right to showcase completed custom projects in our portfolio unless we have signed an NDA (Non-Disclosure Agreement), which must be provided by the client.

Custom Development Projects

Clients receive full ownership rights to all custom code and assets upon final payment
We retain no rights to reuse or resell the custom-developed code unless agreed otherwise in writing
Client may modify, reuse, or repurpose the project without restriction

8. Maintenance & Support

Ready-Made Project Support

3 months bug fix support starting from the date of first successful deployment and license activation on the client’s domain.
Support limited to cPanel environments
Core customizations void support eligibility
No emergency support or guaranteed response times

9. Limitations & Liabilities

Clients are responsible for backing up their website. EnigmaDesigns is not liable for data loss caused by hosting issues, user errors, or force majeure.
Not liable for indirect, special, or consequential damages
No responsibility for GDPR compliance on client implementations
No support for third-party services or integrations

10. Data Handling

We only collect minimal operational data:

Domain names (for license verification)
IP addresses (for security monitoring)
System logs (for troubleshooting)

We do not store personal data, therefore GDPR/ICO compliance is not required.

11. Forbidden Use

No redistribution or reselling without license transfer
No uploading to open-source repositories
No building competing commercial products
No altering license verification scripts

12. Refund Policy

Ready-Made Projects

All sales final after license key delivery
Pre-delivery cancellations: 95% refund (5% processing fee)
No version replacements or upgrades after delivery

13. Termination

Either party may terminate with written notice
Client termination: Payment due for completed work
We may terminate licenses for policy violations

14. Jurisdiction

Governed by laws of the United Kingdom. Exclusive jurisdiction of UK courts.

15. Amendments

We reserve the right to update these terms at any time. Clients will be notified of changes via email or through our website. Continued use of our services indicates agreement to the revised terms.

These terms apply to all brands and services operated by EnigmaDesigns, including but not limited to BuybackEmpire.pro and any future subsidiaries.
