Web Design Terms & Conditions

1. Introduction

These Terms & Conditions apply to all web design projects undertaken by EnigmaDesigns.com. By commissioning a website, the client agrees to be legally bound by these terms.

2. Scope of Work

The project scope, features, and timeline will be outlined in a written quote or agreed communication. Any additional features requested after project commencement may be subject to a separate fee and adjusted delivery timeframe.

3. Payment Terms

• A minimum 50% deposit is required before any design or development work begins (unless otherwise stated).
• The remaining balance is due upon project completion, prior to handover, domain transfer, or site going live.
• Payments are non-refundable once work has commenced.

4. Design Revisions

The project includes up to two (2) rounds of revisions during the design phase. Additional revisions may incur an extra charge at an hourly or fixed rate.

5. Client Responsibilities

• Clients must provide all content, text, images, and relevant information needed for the website within a reasonable timeframe.
• Delays in providing requested content may delay project completion and result in rescheduling fees.
• Clients are responsible for ensuring that any content they provide does not infringe on third-party rights (e.g., copyright or trademarks).

6. Project Delivery

All deliverables are tested and reviewed before launch. Upon final approval and full payment, the site will be handed over or deployed live to the agreed domain/hosting. After this, any further changes are treated as a new job unless under a maintenance agreement.

7. Hosting & Domains

• Unless agreed otherwise, the client is responsible for purchasing and managing their hosting and domain name(s).
• We may assist with setup as a courtesy, but no responsibility is taken for third-party hosting issues unless we are providing hosting.

8. Intellectual Property

Once full payment is received, the client owns the website content and front-end design. However:

• We reserve the right to use frameworks, components, or templates within projects.
• We retain the right to showcase the project in our portfolio or marketing materials.
• Codebase, systems, or admin panels that are part of our in-house CMS remain our intellectual property unless explicitly transferred.

9. Maintenance & Support

Unless a separate maintenance plan is agreed, our obligation ends after final delivery. We may offer fixes for bugs reported within 14 days of handover. Any additional support is billed separately or covered by a service agreement.

10. Limitation of Liability

EnigmaDesigns.com will not be liable for any indirect, special, or consequential damages, or loss of profits, arising out of or related to your use or inability to use the delivered website.

11. Termination

Either party may terminate the project with written notice. If the client terminates, payment will be due for all work completed to date. Deposits are non-refundable after work has begun.

12. Legal Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the United Kingdom, and both parties agree to submit to the exclusive jurisdiction of UK courts.
